Lubborn House ~ Terms and Conditions

General

1.     This is a legally binding contract between the property Owners and the Guest. The Owners are also referred to as "we" and "us".

2.     The Guest is the person who makes the online payment. This person is responsible for ensuring all members of the guest party accept and adhere to these terms and conditions. The Guest is also referred to as "you".

3.     The property referred to is Lubborn House, Lubborn Lane, Baltonsborough, Somerset BA6 8QP.

 

Booking confirmation and payment

1.     By making a booking, you agree to these Terms & Conditions.

2.     A non-refundable deposit of 25% of the total booking amount is required to secure the reservation.

3.     The remaining balance must be paid by 6 weeks prior to the check-in date.

4.     For bookings made within 6 weeks of the check-in date, the full amount is due at the time of booking.

 

Cancellation and refund policy:

1.     Cancellation by the Guest must be made in writing.

2.     Cancellations made outside of any specified periods will be charged the deposit only.

3.     Late cancellations close to the start of stay will be charged as follows:

o   35-41 days before: 50% of booking

o   28-34 days: 60% of booking

o   21-27 days: 70% of booking

o   14-20 days: 80% of booking

o   7-13 days: 90% of booking

o   6 days or less: 100% of booking

4.     In the event of a cancellation, we will attempt to re-let the property and if successful, a discretionary payment may be made. However, we strongly recommend you take out holiday cancellation insurance.

5.     We reserve the right to cancel the booking at any time; in such cases, a full refund will be issued. We shall only be liable to return the monies received. No compensation or consequential losses shall be paid.

Security deposit:

1.     A security deposit of £250 will be required when the remaining balance is paid 6 weeks prior to check-in.

2.     The deposit will be refunded within 14 days after check-out, subject to any deductions for damages or excessive cleaning.

 

Check-in and check-out:

1.     Check-in time is from 4pm-8pm on the day of arrival; and check-out time is by 10am on the day of departure.

2.     Late check-out may incur additional charges unless agreed upon in advance.

 

Occupancy and house rules:

1.     The maximum occupancy of the property must not exceed the number stated in the booking.

2.     The Guest must adhere to any house rules provided by the owners.

3.     No smoking or lit candles are allowed within the property.

4.     No pets are allowed in the property unless agreed upon in advance and the specified fee of £50 per pet is paid. All pets must be house trained, and the number and type of pet must not exceed what was agreed at the time of booking. Pets must not be left on their own in the property at any time and must not be allowed on the beds.

5.     Guests must not move furniture from room to room in the property (except dining chairs) without permission.

6.     All household waste and recycling are to be put in the designated boxes and bins provided in the well shed at the back of the house.

 

Property condition and liability:

1.     The property must be left in a clean and tidy condition upon check-out similar to that in which it was found on arrival.

2.     The guest is liable for any damages caused to the property and its contents during their stay.

3.     The property owner is not responsible for any loss, theft or damage to the guests’ personal belongings during their stay.

4.     If any part of the property or its facilities require urgent repair to fix or make these safe, the Guest should report this to the Owners as soon as possible.

Rights of access:

1.     The Guest must allow the Owners, or their contractors, access to the property at reasonable hours during the day to inspect and carry out any urgent repairs to fix and/or make safe facilities within the property should the need arise.

 

Public indemnity and public liability:

1.     No liability can be accepted by the Owners for any accidental injury, loss or damage to the guest, any member of the Guest’s party or any visitor to the property arising out of or in connection with the use of the property or associated facilities.

2.     The guest must ensure that all visiting children are supervised at all times.

 

Miscellaneous:

1.     Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made, and some things do change. The guest accepts that no refunds are available for such discrepancies.

2.     The property Owner is entitled to ask the guest to leave the property without any refund if, in the property owner's opinion, the behaviour of the guest and/or his/her party is unacceptable or unreasonable.

3.     The property owner reserves the right to refuse entry to anyone, who in the property owner's opinion is not suitable to or capable of taking charge of the property.

Insurance:

1.     The Guest is advised to take out comprehensive travel insurance, including coverage for cancellation, personal liability, and personal property.

 

Force majeure:

1.     The property owner shall not be liable for any failure or delay in performing their obligations due to circumstances beyond their reasonable control.

 

Complaints:

1.     Any complaints regarding the property must be reported to the property Owners promptly to allow for resolution.

 

Governing law and jurisdiction:

1.     These terms and conditions shall be governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
